Contract Counsel Legal Services

The New Mexico Public Defender Department is mandated under the Public Defender Act , 31-15-1 NMSA 1978, to "formulate a fee schedule for attorneys who are not employees of the department who serve as counsel for indigent persons under the Public Defender Act." Section 31-15-7 B (11) NMSA 1978. In accordance with the Public Defender Act, the department issues a Request for Proposals (RFP) under the New Mexico Procurement Code, 13-1-21 NMSA 1978, to elicit proposals from private attorneys who want to serve as counsel for indigent persons who are charged with criminal offenses or delinquent acts in the State's trial and appellate courts. The department conducts the RFP process every two years seeking qualified attorneys to provide contract attorney legal services for the department's clients. Through the RFP process, the department reviews and selects which candidates will be offered contracts to provide legal services under the Public Defender Act. Contracts awarded under the RFP are in effect for two year contracting periods. The Contract Counsel Legal Services (CCLS) division oversees and administers the department's contract attorney representation system. In judicial districts where the department has district office operations, CCLS assigns contract attorneys primarily in cases where the district office has a conflict of interest. In judicial districts with no district office operations, CCLS assigns contract attorneys both as primary and conflict of interest counsel. Overall, the department provides contract counsel legal services in all of the state's judicial districts and appellate courts.
